Dinner Presentation:

Lessons Learned from T. Darren Barker, Michelman and Robinson, LLP, and Dean J. Vlahos, FAIA

Dean J. Vlahos FAIA & Associates, and T. Darren Barker, Michelman and Robinson LLP, will discuss the recent litigation: BEACON RESIDENTIAL v. SOM. Learn about the impact of a recent construction defect litigation decision against SOM and how this may influence liability for Architects and Design Professionals going forward. Twenty years of ongoing construction defect litigation between Owners and Contractors has generally not included Architects and Design Professionals. The recent decision against SOM in the Bay Area high-rise condominium project will potentially bring the Architects and Design Professionals to the construction defect table with increased frequency. Is this decision a new source of revenue for Plaintiffs to fund litigation?

The presentation will cover the following topics:

  • Expansion of the Decision
  • Lessons Learned from other Jurisdictions
  • Impact on Architectural Business
  • Protections against Increase Liability
  • Trial Court decision v. Court of Appeals – “The Duty of Care Owed to Future Homeowners”
